By purchasing leads through Precious Pics Pro's Telegram lead marketplace ("Service"), you agree to the following terms and conditions.
1. Service Description
Precious Pics Pro provides contact information and wedding details for couples seeking photography and videography services. Each purchase constitutes the sale of information only.
2. No Guarantees or Warranties
Lead information is provided "AS IS" without warranties of any kind, express or implied. Specifically:
- We make no guarantee that any lead will result in a booking or contract
- We make no warranty regarding the accuracy or current validity of contact information
- We make no representation that couples will respond to your outreach
- We make no guarantee regarding the couple's budget, timeline, or booking readiness
3. No Refunds
All sales are final. Once lead information is delivered to you via Telegram direct message, no refunds will be issued for any reason, including but not limited to:
- Non-response from the couple
- Couple already booked with another vendor
- Inaccurate or outdated contact information
- Budget or service misalignment
- Change of wedding plans by the couple
4. Buyer Responsibilities
You acknowledge and agree that:
- You are solely responsible for all follow-up communications with leads
- You will comply with all applicable laws, including CAN-SPAM, TCPA, and GDPR
- You will conduct yourself professionally in all client interactions
- You assume all risk associated with pursuing and converting leads
5. Exclusive Use
Each lead is sold only once. Upon purchase, the lead is removed from our marketplace and becomes your exclusive opportunity. You may not resell, transfer, or share purchased lead information with third parties.
6. Indemnification
You agree to indemnify, defend, and hold harmless Precious Pics Pro, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use of purchased lead information
- Your communications with couples
- Your violation of any applicable laws or regulations
- Your breach of these Terms of Service
7. Limitation of Liability
To the maximum extent permitted by law, Precious Pics Pro's total liability for any claim related to the Service shall not exceed the amount you paid for the specific lead in question. We shall not be liable for any indirect, incidental, consequential, or punitive damages.
8. Data Accuracy
While we strive to provide accurate information, lead data is sourced from third-party forms and inquiries. We cannot verify or guarantee the accuracy of information provided by couples.
9. Payment Terms
All payments are processed through Telegram Stars. By purchasing leads, you agree to Telegram's payment terms and conditions. Precious Pics Pro is not responsible for any payment processing issues.
10. Modifications
We reserve the right to modify these Terms of Service at any time. Continued use of the Service after modifications constitutes acceptance of the updated terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Miami-Dade County, Florida.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
